All charges have been dropped against the persons arrested for
trespassing at the residence of Lakehead University President
w. G. Tamblyn on May 1.
The Crown A ttor.ney was forced to withdraw the charges because
Tamblyn, the cooplainant, failed to show up 1.n court Nov. 10th to
testify-- even thoueh he had been subpoenaed by the Crown.
In the New Canada September Special Supplement on Lakehead U.,
we reported that Tamblyn was afraid to come to court, and we
were right.
TAMBLYN SNUBB:i:m HIS NOSE AT THE COURTSt
The Crown Attorney was called the ni ~ht before and told that
Tamblyn couldn't come to the trial because he was in Ottawa.
This is an outrageous snub at the courts, and OLM Chairman Gary
Perly, who was representing most of the defendants, demanded that
Tamblyn be punished for contempt of court.
Provincial Oau~t Judge Duthie asreed tha~ it was serious that
TaI!lblyn ignored a subpoena (which is like a court order to appear
and give testimony) but said that he did not have the jurisdiction
to prosecute Tamblyn and pointed out that ~he Crown Attorney
could take action asai.n st Tamblyn.
TAMBLYN LIED!
The si tuatio.n became much more serious when it was discovered
after the trial that Tamblyn wasn't in Ottawa at all, but was
right here in Thunder Bay.
THE CROWN ATTORHEY IS NOW CONSIDERING L.:..YING CRIMIN.AL CH..:iRGES
AG.UNST W. G. TAMBLYN.
Tamblyn thought he could use the courts for his own vindictive
political purposes:
- he was the complainant who caused the charees to be laid;
-- then, as the boss of two of the defendants, Brian Leekley and
Margie Wally, he fired them using their being arrested as
justification before public opinion;
-- he forced the 11 defendants, the Judge, the Crown Attorney,
the police, and the witnesses to come to court 4 ti~es and to
spend a great deal of time, money, and energy preparing a case;
-- then, at the very last moment, 193 days after the event,
Tamblyn didn't show up and caused the charges to be dropped.
We demand that Tamblyn iJ111:1ediately rehire all those he fired
and pay the losses of all those harmed by his actions.
